This agreement establishes the legal terms between Creators and Fans using the Yelouwh platform, operated by SouthWonders. By registering as a Fan or Creator and using Yelouwh's services, you agree to the terms of this agreement.
 
1. Definitions
  • "Platform" refers to Yelouwh, operated by SouthWonders.
  • "Creator" is any natural or legal person residing in a Latin American country, over 18 years old, who offers content, digital or physical products, and/or services through Yelouwh.
  • "Fan" is any user who purchases content, products, or services offered by a Creator on the platform.
2. Relationship Between Fan and Creator
  • Creators are responsible for complying with all applicable laws related to the products or services they offer.
  • Fans acknowledge they are contracting directly with the Creators, not with Yelouwh.
3. Content and Conduct Rules
Creators agree to:
  • Not publish content that promotes violence, hate, discrimination, child exploitation, or illegal activities.
  • Not publish content that contains excessive nudity or child pornography.
  • Comply with Yelouwh’s content moderation rules, similar to Instagram's standards.
4. Rules for Marketing Products and Services
Creators:
  • May offer digital products, physical goods, or services.
  • May not sell products or services involving alcohol, tobacco, drugs, medications, weapons, explosives, or any other regulated item without a valid license pre-approved by Yelouwh.
  • Must upload legal documentation proving authorization to operate when required (e.g., doctors, lawyers, etc.).
5. Payments and Commissions
  • Yelouwh facilitates transactions between Creators and Fans.
  • A commission set by Yelouwh will be deducted from each transaction.
  • Payments to Creators will only be issued after verifying their identity and/or required licensing documentation.
6. Intellectual Property
  • The Creator retains ownership of the content they publish.
  • By uploading content, the Creator grants Yelouwh a non-exclusive license to host, distribute, and display the content to Fans.
  • Fans may not copy, redistribute, or resell content without the Creator's express permission.
7. Termination
  • Yelouwh may suspend or terminate accounts for violating this agreement or the general Terms and Conditions.
  • Creators or Fans may also cancel their accounts at any time.
8. Limitation of Liability
  • Yelouwh is not responsible for conflicts, errors, losses, or damages resulting from interactions between Fans and Creators.
  • Yelouwh acts solely as a payment facilitator and visibility platform.
9. Jurisdiction
  • This agreement is governed by the laws of the United States of America.
  • Any dispute shall be exclusively submitted to the courts of the United States.
