DMCA Takedown Policy

At SouthWonders, we respect the intellectual property rights of others and expect users of our platform, Yelouwh, to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond promptly to claims of copyright infringement committed using our platform, when such claims are properly reported.

1. Filing a DMCA Takedown Notice
If you are a copyright owner or authorized agent and believe that content available on Yelouwh infringes your copyright, you may submit a written DMCA notice to our designated agent. Your notice must include the following:
  1. A physical or electronic signature of the copyright owner or authorized agent.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the infringing material and information reasonably sufficient to permit us to locate the material (e.g., a direct URL).
  4. Your contact information, including full name, mailing address, telephone number, and email address.
  5. A statement that you have a good faith belief the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in your notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

3. Response to Infringement Notices
Upon receipt of a valid DMCA notice, we will:
  • Promptly remove or disable access to the allegedly infringing content.
  • Notify the user who posted the content that it has been removed or disabled.
  • If applicable, provide the user with an opportunity to submit a counter-notification.

4. Counter-Notification
If you believe content you posted on Yelouwh was removed by mistake or misidentification, you may submit a counter-notification that includes:
  1. Your physical or electronic signature.
  2. Identification of the content that has been removed or disabled and its location before removal.
  3. A statement under penalty of perjury that you have a good faith belief the content was removed or disabled due to mistake or misidentification.
  4. Your name, address, telephone number, and email address.
  5. A statement that you consent to the jurisdiction of the federal court in your district (or the district in which SouthWonders is located if outside the U.S.) and will accept service of process from the person who provided the original takedown notice.
Counter-notifications must be sent to the same DMCA agent listed above.

5. Repeat Infringer Policy
In accordance with the DMCA and other applicable law, SouthWonders has adopted a policy of terminating, in appropriate circumstances, users who are deemed repeat infringers. We may also limit access or terminate the accounts of any users who infringe the intellectual property rights of others, regardless of whether repeated infringement is shown.

  • Filing a false or misleading DMCA notice or counter-notification may result in legal liability.
